This phrase is both inaccurate, and in the area of the Canadian insolvency process, yet still possible.\u00a0 Are you confused yet? <i>What is the source of the confusion?<\/i> Most likely, people confuse the job of a licensed insolvency <a href=\"http:\/\/www.irasmithinc.com\/blog\/bankruptcy-trustee-toronto\/\">trustee<\/a> with the job of a receiver. This is because one of the functions of a licensed trustee is to take possession of the assets of the bankrupt person or company, sell those assets, receive the money and then distribute the money to the creditors as prescribed in the <i>Bankruptcy and Insolvency Act<\/i> (Canada) (BIA).<\/p>\n<p>In this situation, the trustee is receiving funds, but in no way is regarded as a receiver in any legal way. <i>What does a <\/i><a href=\"http:\/\/www.irasmithinc.com\/blog\/when-you-have-debt-problems-contact-a-licensed-trustee\/\"><i>licensed bankruptcy trustee<\/i><\/a><i> do?<\/i> In Toronto, and all of Canada, a <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_why-use-a-trustee.html\">bankruptcy trustee<\/a> is licensed by the Federal government and works on behalf of all the unsecured creditors; this is the case even though the individual or company is the one who chose the licensed trustee prior to assigning itself into bankruptcy. Creditors have rights and are entitled to get their portion of the money owed to them when it is possible from the licensed trustee administering the bankruptcy. \u00a0But in corporate insolvency, there is no term called\u00a0receivership in bankruptcy.<\/p>\n<p>For an individual, a licensed trustee can also help the person look at <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_bankruptcy-alternatives.html\">bankruptcy alternatives<\/a>, such as <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_debt-consolidation.html\">debt consolidation<\/a>, <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_credit_counselling.html\">credit counselling<\/a> and <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_consumer-proposal.html\">consumer proposals<\/a> to deal with creditors and avoid bankruptcy. Consumer proposals reduce and reorganize an individual\u2019s debt and if accepted, the successful <a href=\"http:\/\/www.irasmithinc.com\/blog\/what-you-need-to-know-about-consumer-proposals\/\">consumer proposal<\/a> helps the person recover from their debt and not do as much damage to their credit score. <i>What is a receivership?<\/i><\/p>\n<p><a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-corporate_receivership-and-bankruptcy.html\">Receivership<\/a> is a process that is available to <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-creditor.html\">lenders<\/a> or other secured creditors only (as opposed to bankruptcy which is a remedy for <span style=\"text-decoration: underline;\">unsecured creditors<\/span>) to seize the assets of the company subject to the lender\u2019s security through the appointment of a receiver.\u00a0 The receiver, who also must be a <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_why-use-a-trustee.html\">licensed trustee<\/a>, will determine if the highest recovery can be gained from running the company or shutting it down, all while devising and implementing a plan to sell the assets.\u00a0 This is done in order to recover the greatest amount of money possible under the circumstances for the lender who appointed the receiver.<\/p>\n<p><i>So how can there be a <\/i><a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-creditor.html\"><i>receivership<\/i><\/a><i> in <\/i><a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_the-bankruptcy-process.html\"><i>bankruptcy<\/i><\/a><i>?<\/i> As described in this blog, receivership is a remedy for secured creditors, while BIA proceedings, other than receivership, are a remedy to benefit the unsecured creditors. \u00a0In some cases, it is necessary to have a bankruptcy administration, at the same time there is a receivership.\u00a0 The reasons why are much too complex for the purposes of this blog, but now you know, that although the phrase is inaccurate, it is still possible.<\/p>\n<h2 id='receivership-in-bankruptcy-summary'  id=\"boomdevs_1\"><span style=\"color: #00ccff;\"><strong>Receivership in bankruptcy summary<\/strong><\/span><\/h2>\n<p>Before <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-corporate_receivership-and-bankruptcy.html\">receivership<\/a> or <a href=\"http:\/\/www.irasmithinc.com\/faq.html\">bankruptcy<\/a> becomes your only option, there are <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_bankruptcy-alternatives.html\">\u00a0alternatives<\/a> including <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_credit_counselling.html\">credit counselling<\/a>, <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_debt-consolidation.html\">debt consolidation<\/a>, and <a href=\"http:\/\/www.irasmithinc.com\/bankruptcy_services-personal_consumer-proposal.html\">consumer proposals<\/a>. <a href=\"http:\/\/www.irasmithinc.com\/contact_us.html\">Contact us today<\/a>.
