But sometimes, there is no other option. If you find yourself unable to pay your debts, <\/span><i><span style=\"font-weight: 400;\">filing for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> may be your best bet for a fresh financial start. But before you decide to <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">, you must assess your situation and understand the consequences.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It&#8217;s easy to be overwhelmed when you&#8217;re facing the prospect of <\/span><i><span style=\"font-weight: 400;\">filing for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">. Bankruptcy is a complicated legal proceeding, and the law has established procedures that must be followed in a specific order. If you&#8217;re considering bankruptcy, it&#8217;s important that you understand how the process works and the critical role a <\/span><a href=\"https:\/\/irasmithinc.com\/\"><i><span style=\"font-weight: 400;\">licensed insolvency trustee<\/span><\/i><\/a><span style=\"font-weight: 400;\"> (formerly called either a <\/span><i><span style=\"font-weight: 400;\">trustee in bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> or a <\/span><i><span style=\"font-weight: 400;\">bankruptcy trustee<\/span><\/i><span style=\"font-weight: 400;\"> (<\/span><span style=\"font-weight: 400;\">Trustee<\/span><span style=\"font-weight: 400;\">) plays in that process.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a <em>Trustee<\/em>, I can tell you that bankruptcy is a serious undertaking. It can have a big impact on you financially and emotionally, and there are many important decisions you must make before, during, and after the process. The decisions you make now will have a big impact on your future.\u00a0 As a Trustee, I always first try to help people and companies look at the <\/span><i><span style=\"font-weight: 400;\">alternatives to bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> in order to <\/span><i><span style=\"font-weight: 400;\">avoid bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">, rather than <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">.\u00a0 <\/span><i><span style=\"font-weight: 400;\">Personal bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> or <\/span><i><span style=\"font-weight: 400;\">business bankruptcies<\/span><\/i><span style=\"font-weight: 400;\"> are truly a last resort when there is no other choice.<\/span><\/p>\n<h2 id='how-to-file-for-bankruptcy-canada-let-the-licensed-insolvency-trustee-no-cost-consultation-happen-first'  id=\"boomdevs_3\"><b>How to <\/b><b><i>file for bankruptcy Canada:\u00a0 <\/i><\/b><b>Let the <\/b><b><i>licensed insolvency trustee<\/i><\/b><b> no-cost consultation happen first<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">You may be considering <\/span><i><span style=\"font-weight: 400;\">filing for <a href=\"http:\/\/www.irasmithinc.com\/blog\/filing-for-bankruptcy-in-ontario\/\">bankruptcy<\/a> in Canada<\/span><\/i><span style=\"font-weight: 400;\"> because you have debts that you can no longer pay. If you are <\/span><i><span style=\"font-weight: 400;\">drowning in debt<\/span><\/i><span style=\"font-weight: 400;\">, you might feel like there is no way out. 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It all starts with you going to see a <\/span><a href=\"https:\/\/www.ic.gc.ca\/app\/scr\/tds\/web\/\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Trustee<\/span><\/i><\/a><span style=\"font-weight: 400;\"> for a <\/span><i><span style=\"font-weight: 400;\">free, no-obligation initial consultation<\/span><\/i><span style=\"font-weight: 400;\">.\u00a0 The Trustee will listen to the facts you describe and ask you some questions to gain a better and deeper understanding of your specific situation.\u00a0 The Trustee will then tell you about the various <\/span><i><span style=\"font-weight: 400;\">debt relief options<\/span><\/i><span style=\"font-weight: 400;\"> he or she style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">How does the Trustee&#8217;s <\/span><i><span style=\"font-weight: 400;\">debt assessment<\/span><\/i><span style=\"font-weight: 400;\"> factor into the realistic alternatives available to you to <\/span><i><span style=\"font-weight: 400;\">avoid bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Does your <\/span><i><span style=\"font-weight: 400;\">debt level<\/span><\/i><span style=\"font-weight: 400;\"> at this stage that of <\/span><i><span style=\"font-weight: 400;\">overwhelming debts<\/span><\/i><span style=\"font-weight: 400;\"> or are you right now only feeling mild indigestion? Perhaps you could work out of your <\/span><i><span style=\"font-weight: 400;\">debt problems<\/span><\/i><span style=\"font-weight: 400;\"> on your own with just one or two strategies the <\/span><i><span style=\"font-weight: 400;\">Trustee<\/span><\/i><span style=\"font-weight: 400;\"> will share with you at the no-cost consultation stage.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The Trustee considers all of this to see if you have an <\/span><i><span style=\"font-weight: 400;\">unmanageable debt<\/span><\/i><span style=\"font-weight: 400;\"> to determine the best options available to you, including having you <\/span><i><span style=\"font-weight: 400;\">file for <a href=\"http:\/\/www.irasmithinc.com\/blog\/bankruptcy-means-annulment\/\">bankruptcy<\/a><\/span><\/i><span style=\"font-weight: 400;\">.\u00a0 You don&#8217;t want to do a <\/span><i><span style=\"font-weight: 400;\">consumer bankruptcy filing<\/span><\/i><span style=\"font-weight: 400;\"> for yourself or have your company <\/span><i><span style=\"font-weight: 400;\">filing bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> if it is not necessary to fix the <\/span><i><span style=\"font-weight: 400;\">debt problems<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h2 id='how-to-file-for-bankruptcy-how-the-bankruptcy-process-starts'  id=\"boomdevs_4\"><b>How to <\/b><b><i>file for bankruptcy<\/i><\/b><b> \u2013 How <\/b><b><i>the bankruptcy process<\/i><\/b><b> starts<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Alright, now for getting to answering the question I posed in the title and at the beginning of this Brandon Blog.\u00a0 Can a Canadian <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> from the luxurious <\/span><i><span style=\"font-weight: 400;\">Caribbean<\/span><\/i><span style=\"font-weight: 400;\">?\u00a0 Can Canadian bankruptcy filings start from outside of Canada?\u00a0 To answer this question, we must look at what are the requirements of both the debtor, be it a person or company, and the Trustee, for a <\/span><i><span style=\"font-weight: 400;\">bankruptcy file<\/span><\/i><span style=\"font-weight: 400;\"> to begin?\u00a0 All of my comments below, with appropriate amendments for context, will apply to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">an individual filing a debt settlement consumer proposal;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a person filing for personal bankruptcy;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">either a person or a company filing a debt settlement financial restructuring proposal under Part III Division I of the <\/span><i><span style=\"font-weight: 400;\">Bankruptcy and Insolvency Act<\/span><\/i><span style=\"font-weight: 400;\"> (Canada) (BIA); or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a company filing an <\/span><i><span style=\"font-weight: 400;\">assignment in bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Before the COVID-19 pandemic, the debtor and Trustee met in-person at the Trustee&#8217;s office in order for the Trustee to assess the debtor&#8217;s <\/span><i><span style=\"font-weight: 400;\">financial situation<\/span><\/i><span style=\"font-weight: 400;\">.\u00a0 If an insolvency process was required to help fix the debtor&#8217;s financial problems, then there was also an in-person meeting at the Trustee&#8217;s office to sign up the filing documents.\u00a0 Since the pandemic began, the <\/span><i><span style=\"font-weight: 400;\">Office of the Superintendent of Bankruptcy Canada<\/span><\/i><span style=\"font-weight: 400;\"> (OSB) <\/span><a href=\"https:\/\/www.ic.gc.ca\/eic\/site\/bsf-osb.nsf\/eng\/br04235.html\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Messages to LITs concerning COVID-19<\/span><\/i><\/a><span style=\"font-weight: 400;\"> gave Trustees the authority to hold meetings by video conference.\u00a0 This is how the whole world has been operating for almost 1 year now.\u00a0 So this is how the insolvency process begins.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition to the initial consultation and signup. other meetings are also held via video meetings.\u00a0 Examples are a Meeting of Creditors and the two credit counselling sessions.\u00a0 Although the OSB&#8217;s guidance does say that Trustees can use methods other than in-person&#8230;..&#8221; <\/span><span style=\"font-weight: 400;\">for those areas where they have an approved resident or non-resident office&#8230;&#8221; keep in mind that a Trustee is licensed to act within an entire province!\u00a0 I won&#8217;t get into the semantics of the apparent conflict between the OSB&#8217;s guidance and its licensing approval process in this Brandon Blog.<\/span><\/p>\n<figure id=\"attachment_10387-2\" aria-describedby=\"caption-attachment-10387-2\" style=\"width: 580px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/bit.ly\/3rct600\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-10387\" src=\"http:\/\/www.irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada-1024x576.jpg\" alt=\"file for bankruptcy\" width=\"580\" height=\"326\" data-wp-pid=\"10387\" data-pin-nopin=\"nopin\" title=\"\" srcset=\"https:\/\/irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada-1024x576.jpg 1024w, https:\/\/irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada-300x169.jpg 300w, https:\/\/irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada-768x432.jpg 768w, https:\/\/irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada-1200x675-cropped.jpg 1200w, https:\/\/irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada-150x84.jpg 150w, https:\/\/irasmithinc.com\/blog\/wp-content\/uploads\/2021\/02\/file-for-bankruptcy-canada.jpg 1280w\" sizes=\"auto, (max-width: 580px) 100vw, 580px\" \/><\/a><figcaption id=\"caption-attachment-10387-2\" class=\"wp-caption-text\"><em>file for bankruptcy<\/em><\/figcaption><\/figure>\n<h2 id='who-can-file-for-bankruptcy'  id=\"boomdevs_5\"><b>Who can <\/b><b><i>file for bankruptcy<\/i><\/b><b>?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Any <\/span><i><span style=\"font-weight: 400;\">insolvent person<\/span><\/i><span style=\"font-weight: 400;\"> can <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">.\u00a0 Section 2 of the BIA defines an insolvent person as:<\/span><\/p>\n<p><b><i>&#8220;insolvent person<\/i><\/b><span style=\"font-weight: 400;\">\u2002means a person who is not bankrupt and who resides, carries on business or has property in Canada, whose liabilities to creditors provable as claims under this Act amount to one thousand dollars, and<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>(a)<\/b><span style=\"font-weight: 400;\"> who is for any reason unable to meet his obligations as they generally become due,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>(b)<\/b><span style=\"font-weight: 400;\"> who has ceased paying his current obligations in the ordinary course of business as they generally become due, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>(c)<\/b><span style=\"font-weight: 400;\"> the aggregate of whose property is not, at a fair valuation, sufficient, or, if disposed of at a fairly conducted sale under legal process, would not be sufficient to enable payment of all his obligations, due and accruing due;&#8221;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">So to <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">, amongst other requirements, the person or company must reside, carry on business or have property in Canada.\u00a0\u00a0<\/span><\/li>\n<\/ul>\n<h2 id='the-locality-of-the-debtor'  id=\"boomdevs_6\"><b>The <\/b><b><i>locality of the debtor<\/i><\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Once all the documents are signed up to <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">, the Trustee has to file them with the <\/span><i><span style=\"font-weight: 400;\">OSB<\/span><\/i><span style=\"font-weight: 400;\"> in the &#8220;<\/span><i><span style=\"font-weight: 400;\">locality of the debtor<\/span><\/i><span style=\"font-weight: 400;\">&#8220;.\u00a0 Section 2 of the BIA defines &#8220;locality of the debtor&#8221; as:<\/span><\/p>\n<p><b><i>&#8220;locality of a debtor<\/i><\/b><span style=\"font-weight: 400;\">\u2002means the principal place<\/span><\/p>\n<p><b>(a)<\/b><span style=\"font-weight: 400;\"> where the debtor has carried on business during the year immediately preceding the date of the initial bankruptcy event,<\/span><\/p>\n<p><b>(b)<\/b><span style=\"font-weight: 400;\"> where the debtor has resided during the year immediately preceding the date of the initial bankruptcy event, or<\/span><\/p>\n<p><b>(c)<\/b><span style=\"font-weight: 400;\"> in cases not coming within paragraph (a) or (b), where the greater portion of the property of the debtor is situated;&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the debtor has been living in the Caribbean for 4 months immediately preceding the date of the filing of the <\/span><i><span style=\"font-weight: 400;\">assignment in bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">, do they qualify?\u00a0 The answer is yes.\u00a0 Court decisions have determined that the word &#8220;during&#8221; means &#8220;at some time&#8221; during the year preceding the <\/span><i><span style=\"font-weight: 400;\">date of bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">.\u00a0 It does not mean continuously.\u00a0 So during these pandemic days where we meet with everyone online, it is possible for the Canadian person to be in the Caribbean, meet with the Trustee for the initial consultation, decide on an insolvency process, in this case, bankruptcy and then initiate the bankruptcy proceedings, all from the luxury of a Caribbean vacation spot.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let&#8217;s not delve into how a debtor who needs to <em>file for bankruptcy<\/em> can afford to live in the Caribbean or whose villa it is.\u00a0 That is beyond the scope of this Brandon Blog.<\/span><\/p>\n<h2 id='what-about-the-trustee'  id=\"boomdevs_7\"><b>What about the <\/b><b><i>Trustee<\/i><\/b><b>?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The same way the debtor, or a judge, can transact business by video meeting from outside Canada, the same is true for the Trustee.\u00a0 As long as the Trustee can access all his or her office documents and systems online from outside of the office, there is no reason why the Trustee could not operate from the Caribbean as well to handle the person or company that wants to <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I am not advocating for this position, especially when you consider both the danger of and the appropriateness of travelling during these times of hardship and sacrifice.\u00a0 But since the question was &#8220;Can a Canadian <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy<\/span><\/i><span style=\"font-weight: 400;\"> from the Caribbean or anywhere else in the world?&#8221;, the answer is YES.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So whether you are a judge in the Ontario court, an insolvent debtor or a Trustee, I do not see any legal reason why someone could not file for bankruptcy from the Caribbean or anywhere else in the world.<\/span><\/p>\n<h2 id='file-for-bankruptcy-summary'  id=\"boomdevs_8\"><b><i>File for bankruptcy<\/i><\/b> <b>summary<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">I hope you enjoyed the <\/span><i><span style=\"font-weight: 400;\">file for bankruptcy <\/span><\/i><span style=\"font-weight: 400;\">Brandon Blog post.
